Background

This Data Processing Agreement (“Agreement”) is entered into by and between Tech Guys 2 Go, LLC (the “Processor”) and [Your Company Name] (the “Controller”) regarding the processing of personal data.

Scope

This Agreement outlines the terms and conditions under which the Processor will process personal data on behalf of the Controller.

Data Processing

The Controller will provide personal data to the Processor for the following purposes:

• Purpose of Data Processing: The Controller engages the Processor to process personal data for the purpose of providing remote computer tech support services as described in the main service agreement between the parties.

The Processor will process the personal data in accordance with applicable data protection laws and regulations, including the General Data Protection Regulation (GDPR) (EU) 2016/679.

Data Security

The Processor will implement appropriate technical and organizational measures to ensure the security and confidentiality of the personal data in accordance with the requirements of the GDPR.

Sub-Processors

The Processor may use sub-processors to assist in processing personal data. The Processor will ensure that sub-processors also comply with data protection laws and regulations, and that appropriate data processing agreements are in place with them.

Data Subject Rights

The Processor will assist the Controller in responding to data subject requests regarding their personal data, including requests related to access, rectification, erasure, and data portability, as required by the GDPR.

Data Breach

In the event of a data breach, the Processor will notify the Controller without undue delay, as required by the GDPR. The Processor will also cooperate with the Controller in taking appropriate measures to mitigate the breach and fulfill reporting obligations to supervisory authorities and data subjects, as required by law.

Data Deletion

Upon the termination of this Agreement or at the Controller’s request, the Processor will securely delete or return all personal data, in compliance with the GDPR and any applicable data retention policies outlined in the main service agreement between the parties.

Governing Law

This Agreement is governed by and construed in accordance with the laws of the State of Wyoming and the GDPR where applicable.
